Timeliness and Deemed Liquidation

Featuring

Melanie A. Frank, Esq.
Senior Attorney, International
Office of the Chief Counsel for Import Administration
U.S. Department of Commerce

Craig A. Lewis, Esq.
Partner, Hogan & Hartson, LLP
International Trade Practice Group

Having successfully completed an antidumping duty or countervailing duty administrative review before the U.S. Department of Commerce ("USDOC"), or having concluded an appeal of such a determination to the courts or a NAFTA binational panel, companies/importers are now looking forward to timely liquidation of their merchandise by U.S. Customs and Border Protection ("CBP"). What steps will the USDOC follow to ensure proper and timely liquidation? How does CBP administer USDOC instructions? What are the traps or pitfalls for the unwary importer? Will failure to timely liquidate the entries result in an adverse "deemed liquidation" finding by CBP? What steps should the prudent importer take to minimize her risk? This hands-on presentation, conducted by distinguished leading experts in the field of international trade regulation, will provide attendees with a comprehensive discussion of the impact of a USDOC antidumping order on the liquidation of entries subject to antidumping and countervailing duties.

Determining Jurisdiction under the International Traffic in Arms Regulations (ITAR): Commodity Jurisdiction Process and Related Regulatory and Policy Developments

Featuring:

Ann K. Ganzer
Director, Office of Defense Trade Controls and Policy
Bureau of Political and Military Affairs
U.S. Department of State

* * *
The ITAR can have a significant impact on a variety of transactions, including exports of commodities, transfers of technical data, and provision of services. Virtually any transaction subject to the ITAR controls requires an authorization from the State Department's Directorate of Defense Trade Controls ("DDTC"). Yet, determining whether a particular transaction is governed by the ITAR often is challenging. This is because the ITAR controls not only items traditionally thought of as "arms" but also products and technologies that might not be inherently military, such as commercial satellites and any item specifically designed, configured, adapted or modified for a military application. Ms. Ganzer will discuss DDTC's commodity jurisdiction process for determining the regulatory jurisdiction over defense articles, data and services, as well as related regulatory and policy developments.

Pandemic Flu Preparedness: Potential Impact and Recovery

Featuring

Donna Foster, Pandemic Flu Program Coordinator, Fairfax County Health Department

Dan Gerstein, Vice President, Homeland Security Services, MPRI, Inc.

Joe McMenamin, Partner, McGuireWoods LLP

Aresh Tahbaz, Director, Roche Laboratories Inc. Commercial Operations

CPT. Scott Middlekauff, Office of the Chief Medical Officer, U.S. Department of Homeland Security

Moderated by Debra S. P. Cheng, McGuireWoods LLP

Health authorities globally have been tracking the progress of a strain of avian flu, the H5N1 virus, since 1997. To date, avian flu has rarely affected people, and then, primarily in Asia. The mortality rate among humans affected, however, is in excess of 60%, and there is concern that the H5N1 virus could mutate and result in a pandemic flu with rapid and wide-ranging effects because of the ease with which people and goods cross borders today. The effects from the spread of SARS demonstrated this principle swiftly in 2003.

Today, the potential effects of a pandemic flu are being addressed by all sectors of society, on all levels, not only to help deter a rapid and devastating spread of a pandemic flu, but also to enable government and businesses to continue to function in a pandemic flu event, and to minimize the duration and magnitude of its potential effects. Join us in a discussion with a distinguished panel of experts from both the government and the private sector who will provide a snapshot on the state of pandemic preparedness and issues that should be considered from a business operations, regulatory, and legal perspective.
